The App is offered by Benelli QJ S.r.l. with registered office in Strada
di Fornace vecchia sn, Pesaro, C.F. and P.IVA: IT02229420415
(hereinafter "Benelli") and by B2C Innovation S.p.A., with
registered office in Milan, Corso Magenta n. 69/a, C.F. and P.IVA:
IT05317270964 (hereinafter "B2C"), as business partners, through
a platform managed and owned by B2C.
The privacy policy set out below exclusively concerns the processing of
personal data carried out by Benelli, in its capacity as
Autonomous Data Controller. For the processing of personal data
carried out by B2C, again in its capacity as autonomous data controller
and under its own responsibility, we invite you to consult its privacy
policy available at the relevant link.
The App offers you various functions, but only some of these are provided by Benelli: here below we provide you with information on these functions.
Through the App, in all its versions, Benelli will have access to the data and will be able to provide services differentiated according to the user level on the basis of the data collected by the sensors inside the telematic devices installed on the customer's vehicle or directly through the sensors present in the customer's smartphone (hereinafter, the "Services"); it may also include, among the data used and published, vehicle related information and the customer's personal data (hereinafter, the "Personal Data").
In order to manage our relationship with you and enable you to use the
Services, we may collect and process your Personal Data when you
interact with us through the Services, as described below.
We may also process your Personal Data in order to facilitate our
communications with you (including in case of emergencies), manage
Benelli's business operations, comply with legal or other requirements,
monitor your use of Benelli's systems/Services and perform data
analysis.
However, Benelli will not use your Personal Data for purposes
inconsistent with the aforementioned purposes unless such use is
required or authorized by law, or is necessary to protect your vital
interests.
Benelli processes your Personal Data for the purposes set out in this Privacy Policy on the basis of one or more of the following legal bases: (a) by virtue of a legal obligation to do so; (b) because the processing is necessary for managing or fulfilling the contractual relationship with you; (c) because Benelli has a specific legitimate interest in carrying out the processing (such as, for example, the legitimate interest in protecting the security of Benelli's computer systems and information or in properly managing its business operations and/or preventing fraud); (d) because the processing is necessary to protect a vital interest of a person; or (e) on the basis of your express consent to the processing.
We collect your Personal Data, when you voluntarily choose to provide us
with such information, when you register to access and when you use the
Services and/or the App.
Providing Personal Data is optional, however, failure to provide such
Personal Data may prevent you from using the App and/or the Services in
whole or in part.
Limited to the technical data necessary for the correct functioning of
the App, the provision of the data must be intended as mandatory: the
failure to provide such data implies, in fact, the impossibility to run
the App and, consequently, to use the Services.
The Personal Data we collect may include for example: your first name,
last name or nickname, your date of birth, your landline or mobile phone
number, profile photo, vehicle license plate, vehicle identification
information, average vehicle speed, number of kilometres travelled,
battery charging status and real-time alerts, current vehicle route and
location, driving statistics as well as information you may have shared
with social media apps and about friends you have invited to use the
App.
This data may be combined with other information collected through the
App (e.g. IMEI code of the box, license plate data, distance, routes,
speed, accelerometer data, statistics and aggregate data on a weekly and
monthly basis, etc.).
By voluntarily providing us with Personal Data, you consent to its use
by us in accordance with this Privacy Policy.
Privacy settings can be changed and customized by accessing the relevant
section: Settings > Privacy.
The Services include various location-based features, such as vehicle route mapping. To provide these features, Benelli and its partners and licensors may collect, use, and share precise location data, including the real-time geographic location of your vehicle. This information will only be shared with third parties with your explicit consent, for example if you choose to share content on third party platforms such as Facebook or Google.
Benelli will process your Personal Data for the time necessary to
achieve the purposes set out in this Privacy Policy, unless a longer
retention period is required or permitted by law.
In any case, the criteria for determining the duration of retention of
your Personal Data include: (a) Benelli processes your Personal Data for
the duration of its relationship with you; (b) Benelli processes your
Personal Data when this is necessary to comply with a legal obligation
to which Benelli is subject; (c) Benelli processes your Personal Data in
cases where this is necessary to protect Benelli's position (for
example, to defend its own right in court or carry out investigations).
Access to your Personal Data within Benelli is limited to those
resources that need to know the Personal Data for the purposes described
above (such as, for example, managers, administrative staff as well as
IT, Compliance, Legal, Finance, Corporate Investigations, Audit, Sales,
etc.).
Furthermore, when you provide Personal Data via the Services, you
acknowledge and agree that such Personal Data may be transferred from
your current location to our offices and servers or those of our
partners located in the EU and other countries.
In this regard, we confirm that we only use selected service providers
to provide the App. Furthermore, if such service providers
("Processors") process personal data on our behalf, we have
entered into agreements with them whereby we have agreed to adequate
safeguards to ensure the protection of personal data. For the transfer
of personal data to Processors in third countries, in the absence of an
adequacy decision by the European Commission, EU standard contractual
clauses have been stipulated.
This Privacy Policy applies only to the Services. The Services may contain references or links to other websites that are not managed or controlled by us (the "Third Party Services"). The policies and procedures described herein do not apply to Third Party Services. Links from the Services do not imply our review or endorsement of the Third Party Services. We recommend you to contact those sites directly for information about their privacy policies.
We take appropriate measures to protect Personal Data provided through the Services from loss, misuse, unauthorized access, disclosure, alteration or destruction. These security measures include internal reviews of our data collection, storage and processing practices, and physical security measures to prevent unauthorized access to the systems where we store Personal Data.
The Services which we offer may change from time to time. As a result, we may at times need to make changes to this Privacy Policy. We therefore reserve the right to update or modify this Privacy Policy at any time. Please review this policy periodically and, in particular, before providing any personal information.
Through the Services, we provide you with access to update your profile and review Personal Data previously submitted to the Services.
As a data subject, in the cases expressly provided for by law (art. 15
et seq., EU Regulation 2016/679, so-called "GDPR") you can assert the
following rights against Benelli at any time and free of charge:
request from the Data Controller access to the Personal Data concerning
you, and/or their possible rectification, erasure or - when the
processing is based on consent or on the performance of a contract and
is carried out through automated means - request to receive your
Personal Data in a structured, common and machine-readable format and to
transmit them to another Data Controller;
request from the Data Controller the restriction of the processing
concerning you, or object to the processing;
revoke, at any time, your consent to the processing of Personal Data
concerning you (without prejudice to the lawfulness of the processing
carried out prior to revocation of consent);
lodge a complaint with a supervisory authority (the Italian Data
Protection Authority).
