By accessing and using the myBenelli App or any of its features on any smartphone, tablet or other device, you confirm that you have carefully read and accepted this document containing the Terms and Conditions of the myBenelli App.
These Terms of Use therefore apply to the use of the myBenelli App.
The myBenelli App is offered by B2C Innovation S.p.A., with registered office in Milan, Corso Magenta no. 69/A, Tax Code and VAT no. 05317270964 (hereinafter, for short, "B2C"), using a platform managed by B2C, a partner of Benelli QJ S.r.l. with registered office in Strada di Fornace vecchia sn, Pesaro, Tax Code and VAT no. IT02229420415 (hereinafter, for short, "Benelli"). The platform, as well as other content, features and services, including third party websites that you can access via external links, delimited areas of websites (e.g. sub-pages) and any other offers not marked as offered by B2C, are not under the control or responsibility of B2C itself.
When you connect to the myBenelli App, B2C may receive certain additional information about you or how you use the services provided by the myBenelli App related to geo-location and data recording, through sensors, such as - but not limited to - speed, acceleration, braking, lean angle, vehicle impact, on/off status and battery (hereinafter, for short, "Services"); these Services may be used by you free of charge for the first year from the date of your registration on the myBenelli App; such information will not be used to identify you personally. This information may be collected automatically through various technologies or portals, which contain data relating to your vehicle (e.g. expiry date of ownership tax, expiry date of inspection, vehicle value, etc.). We will use the personal data you provide to us in a manner consistent with our Privacy Policy, the latest version of which can be found at link. If you provide personal data for a specific reason, we may use it only in connection with the reason for which it was provided. We may also use this information to contact you in the future and to inform you about services, which we think may be of interest to you, including through targeted ads based on the interests you show online. We reserve this right on the basis of our legitimate interest, you can find more details about the categories of personal data we collect, the purposes and methods of processing your personal information in our privacy policy.
Also on the basis of our legitimate interest, we may contact you by email, sms, phone or using myBenelli push notifications, if enabled. These communications may include a series of welcome emails, which help inform you about various features of the Services. We may also send you promotional emails if you choose to receive them. If you wish to opt-out of receiving promotional emails at any time, please click the "unsubscribe" link at the bottom of the email. Even if you do, you will continue to receive non-promotional emails with information about the operation of the Services, if you want to change your user privacy settings, open the myBenelli App in the Settings/Privacy section.

You cannot copy, distribute, transmit, modify or tamper with the material contained in the myBenelli App in any way.
You acknowledge that, under your own responsibility and at your own risk, you have carefully and thoroughly examined the features, technical and operational procedures, characteristics and minimum functional requirements of the App, as well as the risks arising from its use, accepting the Services without reservation and recognising them as suitable for your needs, you hereby release B2C and Benelli from any and all liability in this regard, or in relation to the choice of Services and their suitability to meet your current and/or future needs and/or requirements, even if you have represented them to B2C and Benelli or anyone on their behalf prior to acceptance of these conditions. You hereby authorize B2C and Benelli to use their Internet and/or telephone connectivity, as well as to operate their management systems and/or smartphones, provided that this is for the sole purpose of regularly performing the services covered by the App.
You undertake to use the Services in compliance with their characteristics and technical specifications and in accordance with the provisions of these conditions, as well as in compliance with the laws, regulations and customs in force. You undertake not to use the Services improperly and to inform B2C and Benelli, without delay, of any improper use of the same by third parties of which you may become aware. Finally, you undertake to assist B2C and Benelli in every way possible in the execution of the Services and to do everything possible so that they can usefully protect themselves against third parties who have violated their respective rights.
We do not knowingly collect personal data from children under the age of 18 and we do not target our websites to children under the age of 18. We encourage parents and legal guardians to monitor their children's Internet use and help enforce the relevant Privacy Policy by instructing their children never to provide personal data through any of our services without their permission.
